1. Acceptance of Terms

By accessing and using Opinion Jam, you accept and agree to be bound by the terms and provision of this agreement.

2. Eligibility — Adults Only

Opinion Jam is a platform for adults discussing their opinions. It is not intended for minors. By using the service, you confirm that you are at least 18 years old. If you are under 18, you must not use Opinion Jam. We reserve the right to terminate any account we find or believe to be used by a minor.

3. Use License

Permission is granted to temporarily use Opinion Jam for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials
• Use the materials for any commercial purpose or for any public display
• Attempt to reverse engineer any software contained on Opinion Jam
• Remove any copyright or other proprietary notations from the materials

4. User Accounts

You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account.

5. User Conduct

You agree to use Opinion Jam in a respectful and constructive manner. You agree not to:

• Harass, threaten, or harm other users
• Post content that is illegal, harmful, or violates others' rights
• Impersonate any person or entity
• Interfere with or disrupt the service
• Violate any applicable laws or regulations
• Record, screenshot, or otherwise capture conversations without explicit consent from all participants
• Share, publish, or distribute any personal information, usernames, or details about users you converse with without their explicit written consent
• Use any information obtained through conversations on Opinion Jam to contact, identify, or locate users outside of the platform
• Display nudity, sexually explicit content, or otherwise present offensive or inappropriate visual content during video or other live interactions on the platform

Conversations on Opinion Jam are intended to be private and respectful exchanges. Violation of these privacy and conduct rules may result in immediate termination of your account and may have legal consequences.

Disclaimer regarding recording: Although recording, screenshotting, or capturing conversations without consent is prohibited by these Terms, Opinion Jam cannot physically prevent a user from using external hardware or software (such as a phone camera, separate screen recorder, or third-party capture tool) to record their screen or environment. By using the service, you acknowledge this limitation and accept that we are not responsible for such conduct by other users.

6. Content

You retain ownership of any content you post on Opinion Jam. By posting content, you grant Opinion Jam a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content on the platform.

7. Disclaimer

The materials on Opinion Jam are provided on an 'as is' basis. Opinion Jam makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

Opinion Jam shall not be held liable for any issues, harm, loss, or damage of any kind arising from or related to conversations on the platform or your use of the service in general. You participate in conversations and use the service at your own risk.

8. Limitations

In no event shall Opinion Jam or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Opinion Jam.

9. Indemnification

You agree to indemnify, defend, and hold harmless Opinion Jam, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to (a) your use of the service, (b) your violation of these Terms of Service, (c) your violation of any third-party right, or (d) any claim that your conduct (including content you post or your behaviour toward other users) caused harm to another user or a third party. In other words, if someone sues us because of something you did, you agree to cover our costs and losses in connection with that claim.

10. Modifications

Opinion Jam may revise these terms of service at any time without notice. By using this website you are agreeing to be bound by the then current version of these terms of service.

11. Termination

We reserve the right to terminate or suspend your account and access to the service at our sole discretion, without prior notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties.

12. DMCA and Copyright

If you are a copyright owner or an agent thereof and believe that content on Opinion Jam infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act (DMCA) by providing our designated agent with the following in writing: (1) identification of the copyrighted work claimed to have been infringed; (2) identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate it; (3) your contact information; (4) a statement that you have a good-faith belief that use of the material is not authorized by the copyright owner; and (5) a statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner. We may remove or disable access to content that we believe in good faith infringes copyright and may terminate repeat infringers.

13. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or the service shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario.
